These Terms of Service ("Terms") govern your use of the website baliwaysolutions.org and the visa facilitation services provided by PT SDP Gateway Global, trading as Bali Way Solutions ("we", "us", "our", "Bali Way Solutions").
By engaging our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Nature of Our Services: Important
We are a private visa facilitation service. We are NOT a government agency. We are NOT affiliated with the Directorate General of Immigration (Direktorat Jenderal Imigrasi) of the Republic of Indonesia, the Ministry of Law and Human Rights, or any Indonesian embassy or consulate.
Our role is limited to:
- Advising on visa options available under Indonesian immigration law
- Assisting you in preparing and compiling required documents
- Submitting applications to the relevant authorities on your behalf
- Following up on application status where permitted
We do NOT:
- Issue visas, stay permits, or KITAS/KITAP. Only Indonesian immigration authorities have this power
- Influence, expedite, or guarantee the outcome of any application
- Provide legal advice. For legal advice, consult a licensed Indonesian advocate (advokat)
- Provide tax advice. For tax matters, consult a licensed tax consultant
ALL DECISIONS REGARDING VISA APPROVAL, REJECTION, EXTENSION, OR REVOCATION REST SOLELY WITH INDONESIAN IMMIGRATION AUTHORITIES.
3. No Guarantee of Outcome
You expressly acknowledge and agree that:
- (a) We cannot and do not guarantee that any visa application will be approved.
- (b) Indonesian immigration policy, fees, processing times, and eligibility requirements may change without notice at any time. We are not responsible for changes that affect your application.
- (c) Visa processing times depend entirely on the Indonesian authorities. Any timeframe we communicate to you is an estimate based on typical past experience, not a binding commitment.
- (d) An application may be rejected, delayed, or require additional documentation for reasons outside our control, including (but not limited to) errors or inconsistencies in documents you provide, your immigration history, your nationality, security checks, or changes in policy.
- (e) Approval of a previous visa does not guarantee approval of future applications, even for the same visa type.
4. Your Obligations
By engaging our services, you agree to:
- (a) Provide truthful, accurate, complete, and up-to-date information and documents.
- (b) Promptly notify us of any changes to your circumstances that may affect your application.
- (c) Pay our fees in full and on time as set out in your engagement.
- (d) Comply with all Indonesian laws and visa conditions once your visa is issued.
- (e) Not ask us to make, and accept that we will refuse, any request that involves submitting false documents, false statements, or any unlawful arrangement.
You are solely responsible for the accuracy and legality of all information you provide. We may decline to proceed with, or may terminate, any engagement where we suspect fraud, misrepresentation, or unlawful intent, without refund.
5. Fees and Payment
- (a) Our fees are quoted to you in writing before you engage us. Government fees, immigration fees, and third-party charges (such as legalisation, translation, courier, or medical exam fees) are separate and additional unless we expressly state otherwise.
- (b) Payment is by bank transfer to our designated Indonesian bank account. Bank transfer fees are your responsibility.
- (c) Work does not begin until cleared funds are received.
- (d) Government fees, once paid to the Indonesian authorities, are non-refundable in all circumstances. This is a matter of Indonesian government policy, not our policy.
6. Refund Policy
Our refund policy depends on the stage at which you cancel:
- (a) BEFORE document collection begins: Full refund minus bank transfer fees actually incurred by us.
- (b) AFTER document collection begins but BEFORE submission to Indonesian Immigration: Full refund minus bank transfer fees actually incurred by us.
- (c) AFTER submission to Indonesian Immigration: 20% refund of our service fee. No refund of government fees, third-party fees, or fees already disbursed to immigration or its agents.
The following situations are NOT eligible for refund beyond what is set out above:
- Rejection of your application by Indonesian Immigration (unless caused by our verified error)
- Delay in processing by Indonesian authorities
- Change of mind after submission
- Inability to travel due to personal circumstances
- Visa revocation or cancellation after issue
- Termination by us due to your provision of false or misleading information
Refund requests must be made in writing to sdpgateglo@atomicmail.io. Approved refunds will be processed within 30 days to the same bank account from which payment was received.
7. Communication and Document Handling
- (a) Our primary communication channel is email. You are responsible for monitoring the email address you provide and responding to our requests promptly.
- (b) Delays in your response may delay or jeopardise your application. We are not liable for adverse outcomes caused by your failure to respond within timeframes we communicate to you.
- (c) We will return your original documents at the conclusion of our engagement or at your written request. You are responsible for collection or for bearing the cost of secure return shipping.
8. Limitation of Liability
To the maximum extent permitted by Indonesian law:
- (a) Our total aggregate liability to you arising out of or in connection with our services, on any basis whatsoever, shall not exceed the total service fees you have actually paid to us for the specific engagement giving rise to the claim. Government fees, third-party fees, and bank charges are excluded from this cap.
- (b) We are not liable for any indirect, consequential, incidental, special, or punitive damages, including (but not limited to) lost profits, lost business opportunities, travel costs, accommodation costs, missed flights, lost wages, or emotional distress.
- (c) We are not liable for any loss or damage caused by:
- Acts, decisions, or delays of Indonesian immigration authorities or any other government body
- Force majeure events (including natural disasters, pandemics, civil unrest, government action, internet outages, or bank failures)
- Errors, omissions, or misrepresentations in information or documents you provide
- Acts of third parties not under our control
- (d) Nothing in these Terms excludes liability for fraud, gross negligence, or wilful misconduct on our part, or any liability that cannot be excluded under Indonesian law.
9. Intellectual Property
All content on baliwaysolutions.org, including text, graphics, logos, and the structure of the site, is the property of PT SDP Gateway Global or its licensors and is protected by Indonesian and international copyright law. You may not copy, reproduce, or republish our content without our prior written permission.
10. Confidentiality
We treat your information as confidential and handle it in accordance with our Privacy Policy. You agree to treat any non-public commercial information we share with you (such as pricing structures, internal processes, or third-party contacts) as confidential.
11. Termination
- (a) You may terminate our engagement at any time by written notice to sdpgateglo@atomicmail.io. Refunds, if any, will be calculated under Section 6.
- (b) We may terminate our engagement immediately, with no refund beyond what is required by Section 6, if:
- You provide false, misleading, or incomplete information
- You fail to pay fees when due
- You request anything unlawful
- You behave abusively toward our staff
- Continuing the engagement would expose us to legal or regulatory risk
12. Independent Verification
You are encouraged, and have the right, to verify any information we provide with the Indonesian Directorate General of Immigration (imigrasi.go.id) or with a licensed Indonesian advocate or tax consultant. We welcome such verification.
13. No Agency or Partnership
Nothing in our engagement creates a partnership, joint venture, employment, or agency relationship between you and us beyond the limited scope of visa facilitation expressly described in these Terms.
14. Governing Law and Dispute Resolution
- (a) These Terms are governed by the laws of the Republic of Indonesia.
- (b) The parties shall first attempt to resolve any dispute amicably through good-faith discussion. Either party may initiate this by written notice describing the dispute.
- (c) If the dispute is not resolved within 30 days of the written notice, the dispute shall be submitted to the District Court of Cirebon (Pengadilan Negeri Cirebon), which shall have exclusive jurisdiction.
15. Language
These Terms are provided in English for the convenience of our international clients. In the event of any dispute or legal proceeding in Indonesia, an Indonesian-language version of these Terms may be required under Law No. 24 of 2009 on the National Flag, Language, Emblem and Anthem, and we will prepare one at our cost. If there is a conflict between the English and Indonesian versions, the Indonesian version shall prevail in Indonesian courts.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be communicated to active clients by email. Continued use of our services after notification constitutes acceptance of the updated Terms.
